400;\">Atualmente \u00e9 a Lei n.\u00ba 14.133\/2021. Contudo, tal lei n\u00e3o revogou automaticamente o regime anterior previsto na Lei 8.666\/1993 (Lei de Licita\u00e7\u00f5es e Contratos), na Lei 10.520\/2002 (Lei do Preg\u00e3o) e a na Lei 12.262\/2011 (Lei do Regime Diferenciado de Contrata\u00e7\u00f5es P\u00fablicas). Mas aten\u00e7\u00e3o: selecionar a melhor proposta, aquela mais vantajosa para o interesse p\u00fablico, n\u00e3o significa dizer que ser\u00e1 a de menor pre\u00e7o. Al\u00e9m dos requisitos previstos no art. 6\u00ba, XXII, da Lei 14.133\/2021, deve conter as seguintes informa\u00e7\u00f5es:<\/span><\/p><ul><li><span style=\"font-weight: 400;\">Especifica\u00e7\u00e3o do \u00a0 produto, preferencialmente \u00a0 conforme \u00a0 cat\u00e1logo \u00a0 eletr\u00f4nico de padroniza\u00e7\u00e3o, observados os requisitos de qualidade, rendimento, compatibilidade, durabilidade e seguran\u00e7a;<\/span><\/li><li><span style=\"font-weight: 400;\">Indica\u00e7\u00e3o dos locais de entrega dos produtos e das regras para recebimentos provis\u00f3rio e definitivo, quando for o caso;<\/span><\/li><li><span style=\"font-weight: 400;\">Especifica\u00e7\u00e3o da garantia exigida e das condi\u00e7\u00f5es de manuten\u00e7\u00e3o e assist\u00eancia t\u00e9cnica, quando for o caso.\u00a0<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">Na vig\u00eancia da lei anterior, tal documento era chamado de plano de trabalho.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8a9dc68 elementor-widget elementor-widget-heading\" data-id=\"8a9dc68\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Quem \u00e9 a Administra\u00e7\u00e3o P\u00fablica?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f691c3c ha-has-bg-overlay elementor-widget elementor-widget-text-editor\" data-id=\"f691c3c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Administra\u00e7\u00e3o P\u00fablica Direta (Uni\u00e3o, Estados, Munic\u00edpios e Distrito Federal)<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Administra\u00e7\u00e3o Indireta (Autarquias, Funda\u00e7\u00f5es P\u00fablicas, Empresas P\u00fablicas, Sociedades de Economia Mista, Ag\u00eancias Reguladoras, Ag\u00eancias Executivas, Cons\u00f3rcios P\u00fablicos, Fundos Especiais).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Demais entes controlados direta ou indiretamente pelo Poder P\u00fablico.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4da43a6 elementor-widget elementor-widget-heading\" data-id=\"4da43a6\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">O que deve ser observado ao se realizar uma licita\u00e7\u00e3o?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e8c8d8a ha-has-bg-overlay elementor-widget elementor-widget-text-editor\" data-id=\"e8c8d8a\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Para que uma licita\u00e7\u00e3o seja leg\u00edtima, a sua realiza\u00e7\u00e3o deve observar alguns princ\u00edpios b\u00e1sicos:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Competitividade: Visa \u00a0 assegurar \u00a0 que \u00a0 a \u00a0 licita\u00e7\u00e3o \u00a0 promova \u00a0 a \u00a0 maior competitividade poss\u00edvel entre os licitantes, promovendo uma maior participa\u00e7\u00e3o dos interessados e, consequentemente, aumentando as chances de a Administra\u00e7\u00e3o contratar a proposta mais vantajosa.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Igualdade: Significa que a Administra\u00e7\u00e3o n\u00e3o poder\u00e1 fazer distin\u00e7\u00e3o entre os participantes da licita\u00e7\u00e3o.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Vincula\u00e7\u00e3o ao instrumento convocat\u00f3rio (edital): O administrador n\u00e3o pode exigir nem mais e nem menos do que est\u00e1 estabelecido no edital. O edital \u00e9 a lei da licita\u00e7\u00e3o.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Julgamento objetivo:\u00a0 O julgamento na licita\u00e7\u00e3o deve ser pautado em crit\u00e9rios objetivos e impessoais. O edital deve prever de forma clara e precisa qual ser\u00e1 o crit\u00e9rio de julgamento, de sele\u00e7\u00e3o. Os crit\u00e9rios est\u00e3o estabelecidos no art. 33 da Lei n.\u00ba 14.133\/2021 (menor pre\u00e7o, maior desconto, melhor t\u00e9cnica ou conte\u00fado art\u00edstico, t\u00e9cnica e pre\u00e7o, maior lance para leil\u00f5es, maior retorno econ\u00f4mico).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Planejamento: significa o dever de planejar a\u00e7\u00f5es futuras visando escolhas racionais e eficientes, prevenindo poss\u00edveis riscos e desvios.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Segrega\u00e7\u00e3o de fun\u00e7\u00f5es: os agentes p\u00fablicos que participam de uma licita\u00e7\u00e3o devem saber quais as suas fun\u00e7\u00f5es, exercendo-as sem que haja uma acumula\u00e7\u00e3o de fun\u00e7\u00f5es, para que n\u00e3o haja uma centraliza\u00e7\u00e3o \u00a0 em \u00a0 apenas \u00a0 um \u00a0 agente p\u00fablico. \u00a0 Evita \u00a0 conflitos \u00a0 entre \u00a0 os \u00a0 agentes \u00a0 durante \u00a0 o procedimento licitat\u00f3rio.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Desenvolvimento Sustent\u00e1vel: <\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">a licita\u00e7\u00e3o deve seguir crit\u00e9rios que visam equil\u00edbrio econ\u00f4mico, social e ambiental e focam em um consumo\u00a0sustent\u00e1vel.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Formalismo moderado: a Administra\u00e7\u00e3o, no campo da licita\u00e7\u00e3o, n\u00e3o pode levar as formalidades ao extremo. S\u00e3o elas: Preg\u00e3o, Concorr\u00eancia, Concurso, Leil\u00e3o e Di\u00e1logo Competitivo.<\/span><\/p><p><span style=\"font-weight: 400;\">Ap\u00f3s 01.04.2023, as modalidades convite e tomada de pre\u00e7os deixam de existir.<\/span><\/p><p><span style=\"font-weight: 400;\">Apesar disso, faremos uma breve exposi\u00e7\u00e3o acerca das modalidades antes existentes \u00e0 luz da Lei n.\u00ba 8.666\/93, considerando que o presente Portal da Transpar\u00eancia contempla licita\u00e7\u00f5es realizadas nas modalidades anteriores.<\/span><\/p><p><span style=\"font-weight: 400;\">Com base na Lei n.\u00ba 8.666\/93, a modalidade de licita\u00e7\u00e3o era escolhida em virtude do valor e do objeto e, sob tais prismas, poderiam ser realizadas nas seguintes modalidades:<\/span><\/p><p><b>\ud83e\udc6a<\/b><b> Em raz\u00e3o do valor:<\/b><\/p><p><b>&#8211; Convite:\u00a0<\/b><\/p><p><span style=\"font-weight: 400;\">Modalidade de licita\u00e7\u00e3o realizada mediante a convoca\u00e7\u00e3o espec\u00edfica a pessoas determinadas, cuja idoneidade era presumida, e que, em fun\u00e7\u00e3o da estreiteza do chamamento, exigia um m\u00ednimo de publicidade indispens\u00e1vel para a observ\u00e2ncia ao princ\u00edpio da isonomia.<\/span><\/p><p><b>Caracter\u00edsticas: <\/b><span style=\"font-weight: 400;\">n\u00e3o tinha edital, os licitantes eram convocados por meio da carta-convite.<\/span><\/p><p><b>Para obras e servi\u00e7os de engenharia: <\/b><span style=\"font-weight: 400;\">at\u00e9 R$ 150.000,00 (cento e cinq\u00fcenta mil reais).<\/span><\/p><p><b>Para compras e demais servi\u00e7os: <\/b><span style=\"font-weight: 400;\">at\u00e9 R$ 80.000,00 (oitenta mil reais).<\/span><\/p><p><b>Quem podia participar do convite?<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">os licitantes convidados, no m\u00ednimo 3.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Os cadastrados que manifestarem interesse de participar com at\u00e9 24 horas de anteced\u00eancia.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Os n\u00e3o cadastrados podem participar quando convidados ou desde que preencham os requisitos at\u00e9 o 3\u00ba dia anterior.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">A partir de 01.04.2023, essa modalidade deixa de existir.<\/span><\/p><p><b>&#8211; Tomada de pre\u00e7os:<\/b><\/p><p><span style=\"font-weight: 400;\">Modalidade de licita\u00e7\u00e3o realizada mediante a convoca\u00e7\u00e3o gen\u00e9rica a um grupo determinado de pessoas cuja idoneidade j\u00e1 havia sido devidamente comprovada e que, em fun\u00e7\u00e3o da relativa amplitude do chamamento, exigia publicidade suficiente para atingir o grupo de pessoas ao qual se destinava.<\/span><\/p><p><b>Para obras e servi\u00e7os de engenharia: <\/b><span style=\"font-weight: 400;\">at\u00e9 R$ 1.500.000,00 (um milh\u00e3o e quinhentos mil reais).<\/span><\/p><p><b>Para compras e demais servi\u00e7os: <\/b><span style=\"font-weight: 400;\">at\u00e9 R$ 650.000,00 (seiscentos e cinq\u00fcenta mil reais).<\/span><\/p><p><b>&#8211; Concorr\u00eancia:<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">\u00c0 luz da Lei n.\u00ba 8.666\/93, era uma modalidade de licita\u00e7\u00e3o realizada mediante convoca\u00e7\u00e3o gen\u00e9rica de um n\u00famero indeterminado de pessoas, cuja idoneidade se verificava no curso do procedimento e que, em fun\u00e7\u00e3o da m\u00e1xima amplitude do chamamento, exigia grande publicidade.<\/span><\/p><p><b>Para obras e servi\u00e7os de engenharia: <\/b><span style=\"font-weight: 400;\">acima de R$ 1.500.000,00 (um milh\u00e3o e quinhentos reais).<\/span><\/p><p><b>Para compras e demais servi\u00e7os: <\/b><span style=\"font-weight: 400;\">acima de R$ 650.000,00 (seiscentos e cinq\u00fcenta mil reais).<\/span><\/p><p><b>A concorr\u00eancia era obrigat\u00f3ria, quanto ao objeto, em tr\u00eas situa\u00e7\u00f5es:<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Tratando-se de im\u00f3vel, do qual a Administra\u00e7\u00e3o fosse vendedora ou compradora, com duas exce\u00e7\u00f5es previstas na Lei n.\u00ba 8.666\/93;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Quando se tratava de concess\u00e3o (de servi\u00e7os ou de bens);<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Licita\u00e7\u00e3o internacional: quando havia participa\u00e7\u00e3o de empresa estrangeira;<\/span><\/li><\/ul><p><b>PARA MELHOR VISUALIZA\u00c7\u00c3O DAS MODALIDADES \u00c0 LUZ DA LEI N.\u00ba 8.666\/93:<\/b><\/p><p style=\"text-align: center;\"><a href=\"https:\/\/transparencia.tceam.tc.br\/wp-content\/uploads\/2023\/03\/img1a.png\"><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone size-full wp-image-14672\" src=\"https:\/\/transparencia.tceam.tc.br\/wp-content\/uploads\/2023\/03\/img1a.png\" alt=\"\" width=\"768\" height=\"450\" srcset=\"https:\/\/transparencia.tceam.tc.br\/wp-content\/uploads\/2023\/03\/img1a.png 768w, https:\/\/transparencia.tceam.tc.br\/wp-content\/uploads\/2023\/03\/img1a-300x176.png 300w\" sizes=\"(max-width: 768px) 100vw, 768px\" \/><\/a> <a href=\"https:\/\/transparencia.tceam.tc.br\/wp-content\/uploads\/2023\/03\/img1b.png\"><img decoding=\"async\" class=\"alignnone size-full wp-image-14673\" src=\"https:\/\/transparencia.tceam.tc.br\/wp-content\/uploads\/2023\/03\/img1b.png\" alt=\"\" width=\"768\" height=\"450\" srcset=\"https:\/\/transparencia.tceam.tc.br\/wp-content\/uploads\/2023\/03\/img1b.png 768w, https:\/\/transparencia.tceam.tc.br\/wp-content\/uploads\/2023\/03\/img1b-300x176.png 300w\" sizes=\"(max-width: 768px) 100vw, 768px\" \/><\/a><\/p><p><b>\ud83e\udc6a<\/b><b> Em raz\u00e3o do objeto:<\/b><span style=\"font-weight: 400;\"> Concurso, Leil\u00e3o e Preg\u00e3o. Considerando que tais modalidades foram mantidas pela legisla\u00e7\u00e3o nova sem grandes mudan\u00e7as conceituais, vamos abord\u00e1-las a seguir j\u00e1 \u00e0 luz da Lei n.\u00ba 14.133\/2021:<\/span><\/p><p><b>&#8211; Preg\u00e3o:\u00a0<\/b><\/p><p><span style=\"font-weight: 400;\">O preg\u00e3o foi\u00a0 incorporado\u00a0 ao\u00a0 texto\u00a0 da\u00a0 Nova\u00a0 Lei\u00a0 de\u00a0 Licita\u00e7\u00f5es,\u00a0 n\u00e3o\u00a0 estava\u00a0 previsto\u00a0 na\u00a0 Lei 8.666\/93, era tratado em lei pr\u00f3pria.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00c9 modalidade de licita\u00e7\u00e3o obrigat\u00f3ria para\u00a0 aquisi\u00e7\u00e3o\u00a0 de\u00a0 bens\u00a0 e\u00a0 servi\u00e7os comuns (aqueles\u00a0 cujos padr\u00f5es de\u00a0 desempenho\u00a0 e\u00a0 qualidade\u00a0 podem\u00a0 ser\u00a0 objetivamente\u00a0 definidos pelo edital, por meio de especifica\u00e7\u00f5es usuais de mercado), cujo crit\u00e9rio de julgamento poder\u00e1 ser o de menor pre\u00e7o ou o de maior desconto.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Sempre que o objeto possuir padr\u00f5es de desempenho e qualidade que possam ser objetivamente definidos pelo edital, por meio de especifica\u00e7\u00f5es usuais de mercado, ser\u00e1 utilizado o preg\u00e3o.<\/span><\/p><p><b>&#8211; Concurso:\u00a0<\/b><\/p><p><span style=\"font-weight: 400;\">Trata-se de modalidade de licita\u00e7\u00e3o para escolha de trabalho t\u00e9cnico, cient\u00edfico ou art\u00edstico, cujo crit\u00e9rio de julgamento ser\u00e1 o\u00a0 de\u00a0 melhor\u00a0 t\u00e9cnica\u00a0 ou\u00a0 conte\u00fado\u00a0 art\u00edstico,\u00a0 e\u00a0 para\u00a0 concess\u00e3o\u00a0 de pr\u00eamio ou remunera\u00e7\u00e3o ao vencedor.<\/span><\/p><p><span style=\"font-weight: 400;\">Previs\u00e3o legal: art. 30 da Lei n.\u00ba 14.133\/2021.<\/span><\/p><p><b>&#8211; Leil\u00e3o:\u00a0<\/b><\/p><p><span style=\"font-weight: 400;\">\u00c9 a modalidade de procedimento licitat\u00f3rio especificamente destinado \u00e0 venda de bens previamente avaliados, efetuado mediante convoca\u00e7\u00e3o gen\u00e9rica a um n\u00famero indeterminado de pessoas, que apresentar\u00e3o suas propostas mediante lances formulados oralmente, cujo valor ser\u00e1 pago ou garantido imediatamente, e que deve ser precedido de grande publicidade.<\/span><\/p><p><b>IMPORTANTE:<\/b><span style=\"font-weight: 400;\"> Com a edi\u00e7\u00e3o da Lei n.\u00ba 14.133\/2021, o convite e a tomada de pre\u00e7os deixam de existir e a legisla\u00e7\u00e3o passa a prever uma nova modalidade: o Di\u00e1logo Competitivo.<\/span><\/p><p><span style=\"font-weight: 400;\">Trata-se de modalidade de licita\u00e7\u00e3o para contrata\u00e7\u00e3o de obras, servi\u00e7os e compras em que a Administra\u00e7\u00e3o P\u00fablica realiza di\u00e1logos com licitantes previamente selecionados mediante crit\u00e9rios objetivos, com\u00a0 o\u00a0 intuito\u00a0 de\u00a0 desenvolver\u00a0 uma\u00a0 ou\u00a0 mais\u00a0 alternativas\u00a0 capazes\u00a0 de\u00a0 atender\u00a0 \u00e0s\u00a0 suas necessidades, devendo os licitantes apresentar proposta final ap\u00f3s o encerramento dos di\u00e1logos.<\/span> <span style=\"font-weight: 400;\">Est\u00e1 disciplinada no art. 32 da Lei 14.133\/2021.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Buscando tornar ainda mais acess\u00edveis ao cidad\u00e3o os dados constantes do presente Portal, o Tribunal de Contas do Estado do Amazonas disponibiliza nesta p\u00e1gina os principais conceitos referentes ao tema pesquisado na forma abaixo: Acessar diretamente os dados O que \u00e9 Licita\u00e7\u00e3o?
